PUBLICATION ETHICS
The publication ethics of the journal meets the best international practices and standards of publishing scientific periodicals, in particular EASE Guidelines, Principles of Transparency and Best Practice in Scholarly Publishing, Publishing Ethics Resource Kit for Editors, COPE Guise idelines, ICMJE, and criteria and recommendations from DOAJ, Web of Science, Scopus.
Publication ethics also takes into account the provisions of all sections of the Editorial Policy of the journal.
The editorial board of the journal adheres to the following rules for supporting publication ethics:

The editors evaluate the content of the manuscripts for their scientific value, originality, and compliance with other policies of the journal, regardless of race, gender, sexual orientation, religious views, origin, citizenship, or political preferences of the authors.
We encourage the publication and sharing of open data in accordance with the Panton Principles and the FAIR Data Principles. Data can be published in a variety of ways, for example by storing data associated with the article in repositories, or as data files or packages that complement the article. The datasets must be placed in an appropriate trusted repository, and the associated identifier (URL or DOI) of the dataset (s) must be added to the article’s data resources section. References to datasets should also be added to the article reference list from the DOI (if any). If there is no dedicated data store, authors must store their datasets in a shared repository, such as Zenodo or similar.
By submitting the manuscript to the editors, the authors confirm their obligations and responsibilities in the following matters:
The editors reserve the right to reject manuscripts without review if:

The GDPR also makes it possible to recognize the “public interest in data availability,” which is of particular importance for those involved in maintaining the maximum possible integrity of public records of scientific publications.
Authors should identify the sources of funding used to create their manuscript, in particular for research and/or publication. The responsible author (corresponding author) notes information on the financial support of research by specific organizations on behalf of all authors during the submission of the article.
Other sources of support for publications should be indicated in the manuscript, usually in the form of gratitude (for example, for financing payment for translation, language editing of an article, etc.).

POLICY OF AUTHORSHIP AND CO-AUTHORSHIP
The journal authorship policy complies with COPE, Elsevier, and EASE rules and guidelines.
All individuals mentioned in the original article as authors are expected to have made significant contributions to the study.
All persons listed as authors must meet the authorship criteria (ISMJE 2022), in particular, they must:
The journal encourages authors to use the CrediT taxonomy. The editors do not limit the number of authors of a particular publication, it is the responsibility of the co-authors, who should be guided by the requirements outlined in this part for the definition of authorship and co-authorship.
It is not allowed to change the authors of the article at the stage of its consideration by the editorial board. In the event of a dispute between the authors regarding their contribution after submitting the article to the editors, the editors suspend work on the article until the corresponding notice from the authors about the final solution to all problems.
Three types of authorship are unacceptable:
The procedure for placing authors in a publication should be based on a joint decision of the co-authors in accordance with the significance of the contribution of each author.
Individuals who participate in the study but do not meet the journal criteria for authorship must be listed as “Participants” or “Consultants.” For example: persons who helped in the study with advice, provided research space, supported financially, etc.
By submitting the manuscript of the article to the journal, the author certifies accession to the public contract “On the provision of services for the publication of author’s articles”

The article is distributed under the Creative Commons Attribution License International CC-BY. The terms of this license do not affect the rights of the author or other creative artists to protect the integrity and ownership of their work.
The copyright for the layout of the magazine and the cover completely belongs to the editorial board of the journal.
All content is published in good faith, and the opinions expressed by the authors are only theirs and do not necessarily reflect the views of the Editorial Board.
The authors grant the editorial board of the journal a license to publish the article and identify themselves as the first publisher.
THE RIGHTS THAT THE AUTHOR TRANSFERS TO THE EDITORIAL BOARD OF THE JOURNAL “HCJ” INCLUDE:
In all cases, the presence of a bibliographic link to an article or a hyperlink to its electronic copy on the official website of the journal is mandatory.
PERSONAL DATA PROTECTION POLICY
The journal uses the personal data of the authors, taking into account the Statement of Privacy and Confidentiality.
The author, in accordance with the Law of Ukraine “On the Protection of Personal Data” as a subject of personal data, voluntarily, consciously, and unambiguously provides the Editors as the owner of personal data, consent to:
– processing of their data (Article 2 of the Law of Ukraine “On Protection of Personal Data”);
– the use of their data, including any actions of the owner of personal data regarding the processing of these data, actions to protect them, as well as actions to grant a partial or complete right to process personal data to other subjects of relations related to personal data. (Article 10 of the Law of Ukraine “On Personal Data Protection”);
– dissemination of their data, which provides for the actions of the owner of personal data regarding the transfer of information about an individual (Article 14 of the Law of Ukraine “On the Protection of Personal Data”);
– access of third parties to their data (Article 16 of the Law of Ukraine “On Personal Data Protection”).
The author confirms that he was duly notified of the purpose of processing his data, namely, the preparation for publication, review, editing, and publication of the manuscript in the journal “Herald of Criminal Justice,” in print and on the website of the publication, in social networks. The author confirms that the purpose and conditions for processing their data are clear and agree with them.
Personal data may be transferred to/from other electronic information resources solely for their processing (collection), without additional notification of the subject of personal data about such transfer.
ANTI-PLAGIARISM POLICY AND DUPLICATION OF PUBLICATIONS
Plagiarism – publication (partially or completely) of scientific (creative) results obtained by other persons as the results of their research (creativity) and/or reproduction of published texts (published works of art) of other authors without attribution (Article 42 of the Law of Ukraine “On Education”).
The original authors of articles submitted to this journal, which contain significant text borrowings from other articles, monographs, etc., without attribution, will be immediately rejected.
Editors necessarily check manuscripts for similarity of text with the help of iThenticate and Unicheck services, initiating reports (ïThenticate report and Unicheck report).
The journal provides reviewers with the mentioned reports for the final decision on the originality of the manuscript.
The publication (partially or completely) of one’s own previously published scientific results as new scientific results is self-plagiarism. Cases, where authors reuse large parts of their publications without a clear reference to the source, are considered duplication of publication.
To avoid this, when reusing the text from their previously published articles, the author (co-authors) must necessarily arrange this text as a quote with a corresponding sitting on the original source, to avoid misleading readers’ perception of the uniqueness of the new article.
In case of plagiarism, self-plagiarism, or duplication of publications during peer review and editorial processing, the editors reject the article without the right to re-submit. Manuscripts of articles in which, after checking for plagiarism by the Unichesk system and/or iThenticate, a significant percentage of text borrowings were found, the editors returned to the authors for revision.
In case of plagiarism, self-plagiarism, or duplication of publications in an already published article, an announcement will be made on the article page in the journal and the article recall procedure will be launched.
POLICY ON VIOLATIONS OF ACADEMIC INTEGRITY
According to the provision of subparagraph 31 of paragraph 1 of Article 58 of the Law of Ukraine on Higher Education, “scientific-pedagogical, scientific and pedagogical workers are obliged:” to observe academic integrity in the educational process and scientific (creative) activity and ensure its observance by applicants for higher education. “
According to Article 42 of the Law of Ukraine “On Education,” “academic integrity is a set of ethical principles and rules defined by law that should guide participants in the educational process during learning, teaching and conducting scientific (creative) activities to ensure confidence in the results of learning and/or scientific (creative) achievements.”
Violations of academic integrity that can be identified during the editorial and publishing process are:
All allegations of violation of academic integrity should be submitted to the editor-in-chief. In case of suspicion of violation of academic integrity, the editors-in-chief will act in accordance with the current legislation of Ukraine with the relevant COPE instructions and internal policies.
If reviewers or editors comment on a potential violation of academic integrity, authors will be asked to explain. If the explanations are satisfactory and the problem is the result of a mistake or misunderstanding, the problem can be easily solved. If not, the manuscript will be rejected or withdrawn, and the editors may prohibit the publication of such author (s) in the journal for a certain period.
If the allegations relate to authors, the process of reviewing and publishing their submissions will be stopped before the end of the specified process. An investigation will be conducted even if the authors withdraw the manuscript.
If the allegations relate to reviewers or editors, they will be replaced during the review process during the current investigation of the case.
For breaches of academic integrity, authors, reviewers, and/or editors may be held to the following academic responsibility:
Violations of academic integrity do not include “honest mistakes” or differences of opinion.
OPEN ACCESS POLICY
The Criminal Justice Bulletin is an open-access journal, which means that all its content is available free of charge to all readers and their institutions under the Budapest Open Access Initiative. There is no fee for open access.
The editors support the recommendations of the BOAI20, and the UNESCO Recommendations on Open Access and make efforts to implement them in their activities.
All articles published in the public domain will be permanently available for reading, downloading, copying, and distribution under the terms of the Creative Commons Attribution license (CC BY), which allows users to copy, create extracts, abstracts, and new works from an article, modify and redo the article and make commercial use of the article (including reuse and/or resale of the article by commercial entities), provided that the user provides the appropriate link (concerning the official publication through the relevant DOI), provides a link to the license, indicates if changes have been made and the licensor is not presented as approving the use of the work. CONFLICT OF INTEREST POLICY
Editors are obliged to avoid any conflicts of interest between authors, reviewers, and members of the editorial board.
A conflict of interest arises if the persons involved in the editorial process are among themselves and business, professional, personal, or others who can potentially compromise them interfere with objectivity, or influence the resolution of issues related to publication. Conflicts of interest may also be related to employment, sources of funding, personal financial interests, membership in relevant organizations, or other circumstances that may cause bias and affect the decision-making of responsible persons.
During the editorial process, the following relationships between the chief and/or responsible editors, reviewers, and authors are a conflict of interest:
When submitting an article, the author is obliged to report all possible conflicts of interest with the editors of the journal. The author identified by the co-authors as responsible for correspondence with the editors (corresponding author) must declare any conflicts of interest on behalf of all authors.
Once manuscripts are intended for review, reviewers are asked to notify the editor of any conflicts that may arise.
Editors should not edit or manage manuscripts in which they have any conflict of interest resulting from relationships or connections with any of the authors, or companies or institutions associated with the study.
Any statements about conflicts of interest made by authors, reviewers, or editors are considered by the executive editor and/or chief editor of the publication.
POLICY OF COMPLAINTS AND APPEALS
The editors of the magazine intend to promptly and constructively respond to all complaints. The editorial board and staff of the SCC journal will examine the specific case of the complaint according to its nature and complexity, and any decision made will take into account the recommendations provided by the Committee on Publication Ethics (COPE).
Suggestions or complaints should be sent to the email address of the magazine. All notices will be reviewed within thirty business days. However, depending on the degree of complexity of the complaint, additional time will be required to complete the investigation of the case.
The complaint should be concise, and specific and contain enough data to demonstrate any possible violation of publication ethics. If possible, you should also provide additional documents confirming the specific requirement.
Personal complaints against authors, editors, reviewers, or the editorial board of the journal are answered with an indication of the reasons why the complaint was considered beyond the responsibility of the journal. In addition, the journal refrains from conducting an appropriate investigation when complaints are submitted in an insulting, threatening, or defamatory form.
Complaints regarding the scientific quality of the article, such as challenging a refusal to publish
In the appeal, the author must provide a detailed justification with responses to the comments of reviewers on points.
The editor-in-chief considers the arguments of authors and reviewers and makes one of the following decisions:
1) to refuse the applicant because of the groundlessness of the requirements outlined in the appeal;
2) satisfy the requirements outlined in the appeal;
The Complainant is informed of the decision with an explanation. Decisions on appeals are final and new submissions take precedence over appeals.
Complaint regarding the article review procedure (review time, etc.)
The editor-in-chief, along with the editor-in-chief, is investigating the case. The Complainant will be provided with appropriate feedback. The results of the case will be taken into account by the relevant stakeholders to improve the editorial and publishing processes.
Complaints about the ethics of publication, for example, the behavior of the author or reviewer
The Editor-in-Chief or Executive Editor must follow the guidelines of COPE, EASE, and publication ethics.
The final decision to refuse a complaint/appeal cannot be reversed or appealed. The editors do not correspond with the authors of the rejected manuscript after such a decision.
POST-PUBLICATION DISCUSSION AND AMENDMENTS
During discussions of the article after publication, shortcomings of already published articles may be identified, among which there may be significant and insignificant errors that were not identified or that could not be identified during the editorial process.
Editors are obliged to coordinate any changes to the text of the manuscript in the process of editorial and publishing preparation with the authors, in particular, the responsible author. As an exception, insignificant editorial corrections of the text regarding spelling and/or grammar are allowed for publication without the consent of the authors.
Changes and corrections
The journal adheres to Elsevier’s generally accepted rules and recommendations for correcting minor and significant errors in published materials.
Minor changes
Permissible and insignificant errors in a published article that do not affect its content or the scientific integrity of the study (for example, typographical errors, broken vocations, incorrect page numbers in article headings, etc.) can be corrected by publishing changes.
This is done by replacing the original PDF with the corrected PDF along with the correction notice in the Changes tab, detailing the errors and changes made to the original PDF.
The original PDF will be marked with a patch note and a reference to the corrected version of the patch article. The original PDF will also be archived and available by vocation in the same Modified tab.
Correction of significant errors
Corrections are published in the case when after publication in the article reveals significant errors that significantly affect the research integrity and content of the article.
The main reasons for publishing corrections are a change in authorship, unintentional errors in research results, errors in labeling tables and figures, etc.
Corrections are published in a separate publication and registered in their DOI.
The decision to publish errors or corrections is made by the chief editor after discussion with the authors and the responsible editor.
PUBLICATION RECALL POLICY
By the COPE Recall Guidelines followed by our journal, an article may be withdrawn for the following reasons:
Recall Procedure
For the recall procedure, we use the EASE Retraction Form.
The recall should take place after the journal editors have carefully considered the appeals received from the editor (s), the author (s), or the reader (s). (For more information on the procedure for reviewing appeals, see. in the paragraph “Policy of complaints and appeals”
If there are reasonable concerns after the investigation, the authors involved will be contacted at their email addresses and given the opportunity to resolve the issue. Depending on the situation, this may result in the journal taking the following measures, including but not limited to:
– correction can be marked “Changes” (for example, experimental error or miscalculation),
– the article will be withdrawn and posted marked “Withdrawn.”
If, as a result of consideration of such an appeal, it turned out that:
In some cases, authors of an article subject to review by a journal may request a retraction of their manuscript. The corresponding request can be made only before the publication of the article. To review the manuscript, the authors should contact the editorial office of the journal with a letter containing a clear and understandable explanation of the reasons for the review. The letter must be concise and signed by all the authors of the article. The recalled manuscript will be completely deleted from the revision database.

Under no circumstances shall the Journal Editorial Board or any natural or legal personinvolved in the creation, production, or distribution of the journal or its contents be liable under contract, tort (including negligence), or otherwise for any damages, including but not limited to direct, indirect, incidental, special, punitive, indirect, or similar damages, including but not limited to lost profits or revenues, lost use, or similar economic losses arising from the use or inability to use the contents of the journal.
The Journal shall under no circumstances be liable for any loss, damage, or cause of action arisiтg from the use or inability to use the contents of the Journal.
Legal, information discovered, identified, or obtained through the content of the journal is provided only for information and scientific purposes and cannot replace qualified advice of a professional in the field of law.
In any case, the general responsibility of the editorial office for all losses, and offenses (including any types of liability) will not exceed the amount that the author paid to the editorial office in connection with the publication of the article in the journal.
