Review

The possibility of practical implementation by the participants of criminal proceedings, enshrined in the procedural law of the principles of equality and competitiveness, is an important component of the broader right to a fair trial as defined in Art. 6 of the Convention. At the same time, the absence of a legally enforceable guarantee of the parties’ exercise of their procedural rights transforms these principles into a declaration and leads to a violation of fundamental freedoms. Despite the determination of the principles of equality and competition in 2012 when the CCP was adopted, national courts still do not pay sufficient attention to the problems of their practical application. The established jurisprudence inertly responds to the dynamic changes in the approaches to criminal proceedings that are taking place in Ukraine and around the world. The article reviews the legislation governing the procedure for collecting evidence by parties to criminal proceedings regarding the demand and receipt from state authorities, local authorities, enterprises, institutions and organizations, officials and individuals of things, documents, information, expert opinions, conclusions of audits. inspections, carrying out other procedural actions stipulated by the procedural code.

The purpose of this article is to analyze the current legislation of Ukraine, which defines the scope of the rights of the parties to criminal proceedings regarding the extortion, and to obtain them during the gathering of evidence – information, information, things and documents, as well as the analysis of the legislation which, for state authorities, local self-government, enterprises, institutions and organizations, officials and individuals, are obliged to provide such information. To this end, a wide range of legislation has been used and the practice of their application has been elaborated.

The main result of the study is the proposed amendments to the current legislation that will balance the scope of procedural rights of the parties to criminal proceedings to collect evidence. Mech- anisms have been developed to encourage all subjects of these legal relationships to respond more responsibly to their public responsibilities and to facilitate the administration of justice. In particular, it is proposed to change the basic approaches to providing information to the defense party in order to increase the latter’s involvement in the process of proof, and to change the responsibility of state authorities, local self-government, enterprises, institutions and organizations, officials and individuals for preventing a lawyer from obtaining the requested information.
