The essence of protection in criminal proceedings: an actual approach to understanding

The article is devoted to the study of the essential elements of protection in criminal proceedings, which is considered through the prism of the activity approach.
Guided and based on the conceptual foundations of human activity, which is meaningful and consists of separate relatively independent elements that are in a certain relationship and interdependence, sharing the approach of procedural scientists to determine its structural elements, we consider it appropriate identify the internal structural elements of the content of protection in criminal proceedings, which, in our opinion, are the object, subject, purpose, objectives, actions, and subjects that form the protection as a holistic system of activities.
Based on the analysis of various theoretical positions of scientists, a conclusion was made regarding the definition of the object of protection as public relations related to ensuring the realization of rights, freedoms and legitimate interests of the suspect, accused, defendant, convicted, acquitted, whether educational in nature or the issue of their application in criminal proceedings, the person in respect of whom the issue of extradition to a foreign state (extradition) in criminal proceedings is being considered. The subject of protection is defined as the rights, freedoms and legitimate interests of the above persons.
The article examines the essence and relationship between the purpose and objectives of protection. An attempt was made to group the tasks of protection according to certain criteria: (depending on the stage of criminal proceedings; from the position of the person whose protection is carried out; from the application to the protective measures of criminal proceedings (including precautionary measures), etc.).
