Review

The question of the expediency of sounding the competence of the investigating judge to the transfer to the competence of the investigator or the prosecutor of the full approval of the decision on temporary access to information of mobile operators is investigated. Given the amount and content of information to which this procedural action is directed, the potential possibility of limiting the provisions of Art. 32 of the Constitution of Ukraine the right not to interfere in private and family life in the application of this measure to ensure criminal proceedings. With this in mind, the position is defended on the optimality of the competence of the investigating judge determined by the legislator in this part and the inexpediency of changing the current legislation.

The proposal to improve the criminal procedure law in terms of legal regulation of the duty of the investigating judge to take into account the possibility of obtaining things and documents that can be used during the trial to establish the circumstances of criminal proceedings, without temporary access (Part 4 of Article 132 of the CPC)). In particular, it is concluded that despite the structural place- ment of this provision in Art. 132 of the CPC, which regulates the general rules for the application of measures to ensure criminal proceedings, used by the legislator in Part 4 of Art. 132 of the CPC, the phrase «get things and documents», argues that this requirement must be implemented by the investigating judge during the application for temporary access to things and documents, as none of the other measures to ensure criminal proceedings does not provide for such receipt.

Therefore, it is proposed to «transfer» this rule to Chapter 15 of the CPC, which regulates temporary access to things and documents. Also, for the purpose of effective implementation by the investigating judge of this normative requirement, it is deemed expedient to regulate the obligation of a party to criminal proceedings to provide in court a request for temporary access to things and documents with information on the results of: and / or (b) conducting investigative (search) actions aimed at obtaining the required items and documents.
