Problems of developing methods of investigation of criminal offenses
Review
The article examines trends in the development of methods for investigating individual crimes related to the reform of the criminal process in Ukraine. The relevance of issues in criminology is substantiated because of the lack of attention to the analysis of the theoretical positions of the methods of investigation of crimes, as well as the needs of practice, especially in the absence of a methods of investigation of a particular type or group of crimes or insufficient systemacity and specificity of the existing methodology.
The purpose of this article is to review some theoretical provisions of the forensic methods in connection with the transformation of legislation, the gradual introduction of the long-awaited institute of criminal offenses. Sometimes criminalistics methods contain recommendations on issues of criminal law, criminal procedure, but it is more necessary to reflect on them precisely criminalistics means, methods and techniques. To identify a number of problems that arise during creating, developing and using in practice the methods of investigation of criminal offenses, and possible ways to solve them.
Structures of the methods of investigating a small group of crimes (species and subspecies methods) should be built on one scheme in order to provide more effective assistance to practical workers, as opposed to the structure of other methods for investigating crimes.
The methods of investigation of criminal offenses should not be developed by transforming from existing methods of investigation of minor crimes, it should be approached in the light of experience gained in the investigation of crimes of minor gravity, as well as the peculiarities of the procedure for the investigation of criminal offenses.
