Review

Based on analysis of the current criminal legislation of Ukraine, materials of the judicial practice and scientific sources the article highlights the problem issues of qualifying a person’s actions in terms of such element as «entering into a home, other premise or storage» when committing a theft, robbery or assault with intent to rob.

Purpose of this article is to research the definition «entering» as a qualifying element of a theft, robbery or assault with intent to rob as well as to mark its characteristic features that should be taken into account when incriminating this qualifying element.

The authors proposed to understand under «entering» as a qualifying element of crimes against property, the illegal entry (penetration) to a home, other premise or storage with the purpose to gain possession of another person’s property with use of any method by the subject of a crime.

«Entering» as a qualifying element of theft, robbery and assault with intent to rob has the following characteristics: 1) the higher level of social danger (in comparison with the element of the crime provided for in p. 1, 2, art. 185, p. 1, 2 art. 186, p. 1, 2 art. 187 of the Criminal Code of Ukraine); 2) the limited access to the object (home, premises, storages or their separate parts, etc.) at the time of entry (penetration) of the person into it; 3) the person must be aware of the illegality of the entry (penetration) the corresponding premise; 4) person has intention illegally to gain possession of someone else’s property and intention illegally to penetrate (in their aggregate) that arose before the moment of direct entry (getting into) the corresponding premise; 5) the unlawfulness of penetration concerns the manner of access to a home, other premise, storage or staying inside at the time of the beginning the main action.
