The article examines the prospects for the implementation of legal regulation of mediation as an alternative method for solving civil legal disputes.

The authors note that today there is no regulatory framework for regulating mediation, which makes it an alternative way of resolving disputes as complicated. The consolidation of the mediation procedure will solve the existing problems of the judicial system, which often lead to significant losses of forces, time and money, and the courts’ loadings in a large number of cases, and the final judicial decision, which as a rule does not suit at least one of the parties to the dispute, that causes difficulty in its implementation.

The purpose of the article is to provide a detailed analysis of the norms of the current legislation and law enforcement practice, to develop the relevant scientific and theoretical position, to develop proposals and recommendations regarding the regulation of the use of mediation as a form of settlement of civil legal disputes in Ukraine.

In the publication, the authors describe the current state of civil-law support for mediation on the mechanisms available for it, which allow settling civil dispute by concluding a mediation agreement on the results of mediation.

The publication is devoted to the study of the civil law enforcement of mediation as a form of settlement of civil disputes taking into account relevant foreign practice in the context of the prospects for its adaptation in Ukraine, as well as ways to improve the legal and regulatory framework for mediation in Ukraine as an important scientific problem that requires a solution.

The theoretical and practical aspects of the mediation procedure were investigated and concluded that the prospects for introducing legal regulation of mediation are seen in improving legislation, studying the norms of legislation of other states, borrowing world experience, etc. Therefore, we are proposing to amend the draft Law of Ukraine «On Mediation» of 12.17.2012 № 3665.
