A THOROUGH STUDY OF THE THEORY AND PRACTICE OF THE PROSECUTION FUNCTION IN CRIMINAL PROCEEDINGS OF UKRAINE

In their review of V.O. Hryniuk's monograph “The Prosecution Function in Criminal Proceedings of Ukraine: Theory and Practice” (K.: Alerta, 2016. - 358 p.), Doctors of Law, Professors S.S. Cherniavskyi and L.D. Udalova note the high scientific level of the work and its thorough analysis of key aspects of the prosecution function in the criminal proceedings system of Ukraine.
The author provides a comprehensive analysis of:
the theoretical and legal foundations of the prosecution function, its content and subjects (Chapter 1)
formation of the prosecution at the pre-trial stage, classification of the grounds for notification of suspicion (Section 2);
maintaining public prosecution during the preparatory proceedings and the trial, including special procedures and the institution of review of court decisions (Section 3);
the specifics of prosecution on the basis of plea agreements, in private proceedings and in special procedures (Section 4).
The methodological and empirical basis of the study, the logical structure of the monograph and the validity of the proposals for improving criminal procedure legislation are highly appreciated. Among the shortcomings, the reviewers note the insufficient generalization of proposals for optimizing the procedures for the defense to work with evidence in pre-trial proceedings and the combination of subjects and types of prosecution in one subsection, which requires a clearer division.
The review is intended for scholars, lecturers, doctoral students, judicial and law enforcement officials, attorneys and anyone interested in criminal procedure.
